Mind on the Net Services
This document applies to all services that can be purchased through either online ordering tools found on Mind on the Net site, or other channels of information by the Customer. Mind on the Net reserves the right to make changes to any of its services without prior notification to its customers when need neccesites, however will utilize all means that customers and the services they receive will be preserved. All customers who are purchasing services from Mind on the Net, confirm that they sign under the terms in this document by checking “I agree with Terms of Service” box in the internet ordering utility prior to their purchase.
Validity Term
This agreement automatically renews itself at the start of each period that services are received. Cancelling of the terms, which will result in canceling of the agreement can only be possible by 20 days prior notification by either party. If no such action takes place, this agreement will renew itself and will be considered valid for the next service period the customers receive the service.
Cancelling the Agreement
Customers can end this agreement by giving 20 days prior notice to Mind on the Net, by either written notification or via e-mail. Customers will still be responsible for the services they have received prior to cancellation notification date, but will be refunded for any prepaid services reaching beyond date of cancellation notification. Also, any form of setup or design fees will not be refunded. If any equipment or hardware has been purchased on behalf of the customers by Mind on the Net, these will not be refunded in any way. Mind on the Net does not assume responsibility for unauthorized cancellations or erroneous cancellations on customers’ behalf.
Limits
Customers agree that they will not exceed, if there are any, allotted quotas on either bandwidth or disk space usage or any limit of any sorts. Mind on the Net reserves the right to suspend any customer’s services if they exceed their allotted limits, and customers agree to indemnify Mind on the Net from any moral or financial damages they or their clients may suffer due to result of this suspension. Mind on the Net agrees to utilize every possible means to notify the customer of the situation and reach a solution before suspension of services occur. Mind on the Net may incur additional charges payable in the next billing period proportional to the extra bandwidth or extra disk usage or any extra measurable service that exceeds the pre-allotted limits of the service purchased.
Fees
Customers agree that they will pay for the services Mind on the Net renders, periodically for services that Mind on the Net defines as requiring recurring payment, and one time fees for services that Mind on the Net defines as flat one time fees. Customers agree that Mind on the Net may change the amount it charges for any services at its own discretion. Mind on the Net agrees that Customers will be notified of the price changes prior to their recurring or one-time payments, and Mind on the Net agrees that new rates will be applied to Customers’ accounts in the next payment term for recurring fee defined services or at the next purchase for one time paid services.
Acceptable Use
Customers agree to abide by the terms defining acceptable use for the services Mind on the Net offers, contained herein. Any occurence of any violation of acceptable use policy grants Mind on the Net the right to take corrective action, which can include termination of the services rendered by Mind on the Net to customer and notification of authorities and legal action. Mind on the Net agrees to refund the customer for any services not rendered, but prepaid. Customer agrees that Mind on the Net might cancel the services rendered without prior notification in case of acceptable use violation.
Indemnification
Customers agree to indemnify Mind on the Net, any of its right holders, employees and affiliates, from any legal issue that might arise from Customers’ misusage of the services rendered by Mind on the Net, regarding any international or national or regional law. Customer also agrees that this indemnification covers any moral, legal, copyright, financial or any other sort of damages damages that might affect any third party, or the customers themselves.
Intellectual Properties and/or Rights
Customers agree to refrain from any infringement of intellectual property or right holder’s rights that are asserted by international, national or local laws. Customers also indemnify Mind on the Net from any sort of damages or legal issues that might arise from their violation of intellectual property rights concerning any third party. Furthermore customers agree that Mind on the Net will terminate their services without prior notification if such infringement occurs.
Legal Fees
In any legal cases occuring from violation of this terms of service agreement, customer agrees to pay any legal costs and fees that may arise from legal proceedings, including, but not limited to court expenses and attorneys’ fees.
Unrenderebility of services due to extraordinary circumstances
Customers agree to indemnify Mind on the Net from any sort of damages that might incur from unaccounted outages in service due to factors including, but not limited to acts of terrorism, earthquakes, fires or the like. Mind on the Net will try to make sure that every possible resource is utilized to prevent customers from any such damages.
Private Information
Both the customers and Mind on the Net agree that both parties will utilize and use reasonable degree of private information about the other party which are neccessary for routine procedures including, but not limited to invoicing, billing, postage and the like. Both parties agree that such information will in no way be sold or made available to use for any third party.
Unacceptable content
We do not accept any element of code, database, mail, or user interface service as well as sites, that serve any racial discrimination ends. We will not accept any sites or any internet related elements for any individual or institution or corporation that is related to fur industry, shopping sites that sells furs even as only an item in a large inventory or whatsoever. Hack, crack, security related sites also are not accepted.
No Adult sites
Any sort of adult sites, sites selling or serving adult content or affiliate sites are not accepted by any means. Customers using their accounts for these purposes will find their accounts canceled without warning, and they will be refunded for their remaining term.
Outgoing unsolicited email
Customers agree that they will refrain from sending unsolicited email (SPAM) to thirt party email adresses or Mind on the Net. Customers indemnify Mind on the Net, Mind on the Net right holders, Mind on the Net affiliates and partners from any legal and/or moral consequence(s) that may arise from their violation of this agreement.
Incoming unsolicited email
Mind on the Net agrees to refrain from sending unsolicited email to Customers, and agrees to utilize all possible means to protect Customers from unsolicited emails (SPAM) coming from third party adresses. However, Customers agree that it is impossible to prevent all unsolicited email due to nature of internet communications, and they agree that they may receive a reasonable amount of incoming unsolicited email. Customers agree to indemnify Mind on the Net from any legal or moral consequences that might arise from their receiving unsolicited email (SPAM).
Mass Emailing
Customers agree that they will inform Mind on the Net before running regular and/or infrequent mass mailing operations through any means, and using allowed channel and methods as devised by Mind on the Net.
Sales & Ongoing payments
Mind on the Net utilizes Paypal Inc. as distributors for the services it provides. Sales and ongoing payments for recurring costs will be made via mentioned channels.
